1. Scope and Purpose
These Terms and Conditions govern the access and use of Focal Point’s website, as well as the contracting of its remote digital services.
By browsing or using our services, you expressly accept these terms.

2. Services Offered
Focal Point provides professional services in:

- Performance-based digital marketing consulting
- SEO/SEM optimization and organic visibility
All services are custom-designed for each client following a briefing, diagnosis, and personalized proposal process.
Focal Point does not work with generic models or standard templates, but rather with scalable solutions aimed at sustainable results.
3. Contracting Conditions
- The process begins with a briefing form or a discovery meeting.
- After a strategic analysis, a technical and financial proposal is delivered.
- Acceptance of the proposal (via email, form, or contract) is considered a formal commitment.
- The schedule and execution are structured in clear phases, with validations from the client.
4. Intellectual Property
- All content generated during a project (design, texts, code, structures, strategy) remains the property of Focal Point until full payment for the service is made.
- The client obtains full usage rights to the deliverables once the final payment is completed.
- Reuse of discarded proposals, working documents, or other deliverables without a signed contract is strictly prohibited.
5. Cancellations, Refunds, and Guarantees
- Once work has begun, no refunds will be issued.
- Early cancellations must be notified at least 15 days in advance.
- If the client fails to provide key materials or does not meet validation deadlines, Focal Point may suspend or reschedule the project.
- We guarantee professionalism, quality, and ongoing support, but not final results dependent on external factors (such as sales, rankings, or immediate ROI).
6. Limited Liability
- Focal Point shall not be liable for failures resulting from changes in external platforms, third-party interruptions, or conditions beyond its control.
- Any financial liability will be limited to the amount paid by the client for the specific service.
- We recommend following the provided guidance to achieve the best projected outcome.
7. Confidentiality and NDA
- All information provided by the client is considered confidential.
- We sign non-disclosure agreements (NDA) upon the client’s request.
- No materials, processes, strategies, or results will be shared without explicit consent.
8. Applicable Law and Dispute Resolution
- This agreement is governed by the laws in force in Spain and the European Union.
- In the event of disputes, parties may opt for amicable resolution, digital arbitration, or ordinary courts.
- International clients may propose alternative jurisdictions by written agreement.
